This session will explore the Supreme Court’s recent decision limiting the level of deference that must be given to federal agency rulemaking efforts and review how the Loeper and subsequent decisions have and will impact the franchising model.  The panelists will also cover how rulemaking and statutory interpretation has changed at the various federal agencies such as the Department of Labor, Equal Employment Opportunity Commission, Federal Trade Commission, the National Labor Relations Board and the Occupational Safety and Health Administration, as a result.  Finally, our panelists will update the audience on the status of legal challenges to critical initiatives impacting all franchise systems such as the standards for joint employment, independent contracting, union organizing and the proposed ban on non-compete agreements.
