IFA: NLRB ETHICS REPORT THOROUGH, CLEAR

Franchise Association Says Board Review Can Pave Way for Rulemakings

(WASHINGTON, D.C., NOVEMBER 19) – The International Franchise Association (IFA) today applauded the National Labor Relations Board (NLRB) on the conclusion of its ethics review related to Board processes.

The review, which was released this morning, shows the NLRB maintains the highest ethical standards related to its rulemaking and judgment processes. The report particularly notes the questions surrounding Board member recusals during the Hy-Brand case.

“This report shows that the NLRB maintains the highest level of ethical standards. Importantly, it can allow for clear recusal processes as the Board considers rulemakings,” said Matt Haller, IFA Senior Vice President of Government Relations and Public Affairs. “This is particularly important for franchise businesses, who have suffered from a 93% increase in lawsuits due to joint employer uncertainty following the NLRB’s 2015 joint employer rulemaking.”

The ethics report can allow the Board to move forward with important rulemakings, particularly on to the joint employer standard, with a clear understanding of Board member responsibilities.

Under an expanded joint employer standard, franchises have faced a 93% increase in lawsuits while slowing growth by $33.3 billion annually. America’s 733,000 franchise businesses employ more than 7.6 million Americans.
