This intensive two-part session equips in-house franchise counsel with practical tools to navigate two of the most rapidly evolving legal challenges facing franchise systems today: (1) the expanding legal risks of artificial intelligence across the franchise relationship and (2) FDD disclosure compliance in an increasingly volatile cost environment. Part 1 equips counsel to negotiate AI vendor agreements, draft enforceable workplace AI policies, and build system-wide AI governance structures that manage brand risk, franchisee pushback, and emerging disclosure obligations — all against a patchwork of federal and state AI regulation that continues to expand. Part 2 addresses the lasting impact of the FTC’s 2024 guidance on undisclosed fees, the challenge of disclosing dynamic technology-related costs that vendors themselves cannot fully quantify, and strategies for building the cross-functional disclosure governance infrastructure needed to keep pace with growing regulatory expectations. Attendees will leave with concrete drafting strategies, compliance frameworks, and governance tools ready for immediate implementation.
