IFA RESPONDS TO THE U.S. COURT OF APPEALS HOME HEALTH CARE RULING
WASHINGTON, Aug. 21, 2015—International Franchise Association Executive Vice President of Government Relations & Public Policy Robert Cresanti released the below statement following a decision by U.S. Court of Appeals for the D.C. Circuit in the Home Care Association v. David Weil case. The D.C. Circuit reversed the lower court and reinstated a rule imposed by unelected bureaucrats of the Obama Administration that overturns four decades of federal law. That law had ensured elderly Americans could access better quality and affordable in-home care. IFA challenged the rule, along with the Home Care Association of America and the National Association for Home Care and Hospice, arguing that the administration exceeded its regulatory authority.
“IFA is extremely disappointed in this decision and we will continue to examine all of our legal options to appeal this decision in order to protect the interests of elderly and disabled Americans and the franchisees that provide in-home services for them. This case is yet another example of why this Administration and the Democratic leadership of the U.S. Senate used the nuclear option to change the rules and stack the D.C. Circuit with liberal judges that would uphold regulations that do not comply with the rule of law. The decision is not only another blatant example of administrative policymaking by regulatory and judicial fiat, but it also clearly highlights how the rule of law and the free enterprise system continue to suffer under judges confirmed by the U.S. Senate through the nuclear option.”
