IFA STATEMENT ON TEMPORARY STAY FOR REMAINING OVERTIME REGULATIONS  


WASHINGTON, Dec. 31, 2014—International Franchise Association (IFA) President & CEO Steve Caldeira, CFE, today issued the following statement regarding the recent ruling granting a temporary stay of U.S. Department of Labor overtime regulations for home care workers: 


“Last week, the court rightly rejected a portion of the DOL’s most recent overreaching regulations that would have disrupted the growth and prosperity of local franchise business owners across the country. Today’s temporary stay of other parts of the rule is an acknowledgement that these damaging provisions should be subject to very close scrutiny by the courts, and the IFA and its co-plaintiffs will continue to vigorously challenge the ill-conceived regulations through litigation. 


“Today’s ruling is a significant step in protecting clients, workers and local franchise business owners in the home care industry. It is a great example of the courts weighing in to stop executive overreach at the expense of business owners and the creation of business certainty. We are continuously encouraged by the court’s willingness to hold the Administration accountable for misguided policies pursued in defiance of congressional intent and legal precedent.” 


U.S. District Court for the District of Columbia judge Richard Leon threw out the portion of the new regulations that barred third party employers from using the overtime exemption for companion care workers last week. IFA joined co-plaintiffs National Association of Home Care and Hospice and Home Care Association of America in the lawsuit.
