IFA WELCOMES U.S. SUPREME COURT DECISION TO HEAR CASE ON CONSTITUTIONALITY OF PRESIDENT OBAMA’S RECESS APPOINTMENTS TO NLRB


WASHINGTON, June 24, 2013—International Franchise Association President & CEO Steve Caldeira issued the following statement in response to the Supreme Court agreeing to hear the case of NLRB vs. Noel Canning. The Coalition for Democratic Workplace, a group of over 600 employers, associations and other organizations of which IFA is a Management Committee member, filed an amicus brief urging the Supreme Court to take up the case.


“President Obama’s recess appointments have cast serious doubt on the legitimacy of any new NLRB decisions for franchise small businesses and have led to uncertainty in the business environment for all businesses across the country.


“IFA and the CDW argued that when President Obama made his three ‘recess’ appointments to the National Labor Relations Board that they were unconstitutional and that some board actions taken in the wake of those appointments were invalid.


“Earlier this year, a second appeals court joined the D.C. Circuit ruling that President Obama’s recess appointments were unconstitutional and that some board actions taken in the wake of those appointments were invalid. We welcome today’s decision by the Supreme Court to hear the Noel Canning case and are hopeful the Court’s decision will ultimately validate the unconstitutionality of these appointments and ease some of the uncertainty the NLRB has created over business conditions within the franchising community.”
