IFA APPLAUDS COURT DECISION FINDING OBAMA RECESS NLRB APPOINTMENTS ILLEGAL


WASHINGTON, May 16, 2013—The International Franchise Association applauded the Third Circuit U.S. Court of Appeals’ decision today ruling that the National Labor Relations Board (NLRB) recess appointments made by President Obama are illegal. The action today mirrors a ruling of the D.C. Circuit Court in January.


“We are pleased that a second appeals court has joined the D.C. Circuit ruling that President Obama’s recess appointments were unconstitutional and that some board actions taken in the wake of those appointments were invalid,” said IFA Senior Vice President, Government Relations & Public Policy Judith Thorman. “President Obama’s recess appointments have cast serious doubt on the legitimacy of any new NLRB decisions for franchise small businesses and this ruling may ease some uncertainty over business conditions within the franchising community moving forward.”


The decision in New Vista Nursing and Rehabilitation v NLRB is the second illegal ruling in NLRB recess appointments. The previous ruling, Noel Canning v. NLRB, was supported by IFA and other business organizations.


IFA serves on the management committee of the Coalition for a Democratic Workplace, a coalition of over 600 employers, associations and other organizations operating in every Congressional District, holding the NLRB accountable.
