IFA ISSUES KEY VOTE TO SENATE URGING DISAPPROVAL OF NLRB AMBUSH ELECTION RULE


WASHINGTON, April 23, 2012 – The International Franchise Association, on behalf of America’s 825,000 franchise establishments, nearly 18 million workers and $2.1 trillion in economic activity, today urged Senators to support S. J. Res. 36, a joint resolution providing for congressional disapproval and nullification of the National Labor Relations Board’s (NLRB) rule related to representation election procedures.


“Franchise job creators are concerned with mounting threats to the basic tenets of free enterprise,” said Jay Perron, IFA Vice President of Government Relations & Public Policy in the Key Vote letter delivered to Senators. “This ‘ambush’ election rule is the Board’s attempt to placate organized labor by effectively denying employees’ access to critical information about unions and stripping employers of free speech and due process rights. The rule poses a threat to both employees and employers by limiting employees’ opportunity to hear from employers and make an informed choice as well as diminishing employers’ due process.”


As a Management Committee leader in the Coalition for a Democratic Workplace, the IFA plays a critical role in holding the NLRB accountable for the many unlawful decisions it has made or proposed in the last year. CDW has filed suit against the NLRB in the U.S. District Court for the District of Columbia on the Ambush Election rule and expects a court ruling prior to the April 30th implementation. Similarly, on April 13, a federal district court in South Carolina struck down the National Labor Relations Board’s (NLRB) “Notice Posting Rule” which would have required businesses to post a biased notice explaining an employee’s right to organize as a union. CDW had challenged the ruling in a lawsuit.
