IFA Applauds Congressional Challenge to NLRB Ambush Election Rules

WASHINGTON, Feb.16 – The International Franchise Association (IFA) today applauded
members of the House and Senate on their challenge to the National Labor Relations Board’s (NLRB) recent ambush election rules. The harmful new rule effectively shortens labor election time frames, limiting employees’ opportunity to hear from employers and make an informed choice and diminishes employers’ due process.


Senate Health, Education, Labor, and Pensions Committee Ranking Member Mike Enzi (R-WY) joined House Education and the Workforce Committee Chairman John Kline (R-MN), Senate Subcommittee on Employment and Workplace Safety Ranking Member Johnny Isakson (R-GA), House Subcommittee on Health, Employment, Labor, and Pensions Chairman Phil Roe (R-TN) and Representative Phil Gingrey (R-GA) to introduce Resolutions of Disapproval in both the Senate and House on the NLRB’s new rules.


“We appreciate that these Members of Congress recognize the importance of this issue and are willing to utilize the rarely invoked Congressional Review Act to overrule this harmful new regulation. The rule would greatly impair the business community, in particular, the 825,000 franchise establishments in America, which collectively support nearly 18 million jobs or 12 percent of the U.S. private sector workforce,” said IFA President & CEO Steve Caldeira. “Given the President’s recent recess appointments and harmful new rules like the ambush elections, it is critically important that we act with urgency to restore balance to the NLRB on behalf of our industry and we hope that Congress will take action on these important Resolutions.”



The Congressional Review Act (CRA) allows the Senate or House to introduce a Resolution of Disapproval with the full force of law to stop a federal agency like NLRB from implementing a recent rule or regulation.  A Resolution of Disapproval introduced under the CRA cannot be filibustered and requires only a simple majority in the Senate to pass if acted upon during a 60-day window.


IFA is currently engaged in a lawsuit filed by the Coalition for a Democratic Workplace and the U.S. Chamber of Commerce against the NLRB’s ambush election regulation. IFA serves on the management committee of the CDW and fully supports the intent of CDW, the Chamber and many other business groups against this harmful ruling.
